Estos Términos constituyen un acuerdo entre usted y ROLY STUDIO LLC respecto del uso de FlyerView en iOS y Android. Al crear una cuenta, acceder o utilizar FlyerView, usted acepta estos Términos y nuestra Política de Privacidad.

1. Quiénes somos y aceptación

FlyerView es una aplicación desarrollada y operada por ROLY STUDIO LLC (“FlyerView”, “nosotros” o “nuestro”), una empresa establecida en Estados Unidos. Estos Términos y Condiciones (“Términos”) regulan su acceso y uso de la aplicación FlyerView (“App”), sus funciones, contenido y servicios relacionados.

Si no acepta estos Términos, no utilice FlyerView. Si utiliza la App en nombre de una empresa u organización, declara que tiene autoridad para obligarla a estos Términos.

2. Elegibilidad y cuentas

Debe tener al menos 18 años y capacidad legal para aceptar estos Términos. La App no está destinada a menores.

Debe proporcionar información exacta, mantenerla actualizada, proteger sus credenciales y notificarnos si sospecha acceso no autorizado. Usted es responsable de la actividad realizada desde su cuenta, salvo cuando la ley disponga lo contrario. No puede vender, transferir, alquilar ni compartir una cuenta de forma que comprometa su seguridad o el funcionamiento de FlyerView.

Podemos solicitar verificaciones razonables para proteger cuentas, validar suscripciones, investigar fraude o confirmar que una persona está autorizada para administrar un negocio.

3. Plataformas y tipos de cuenta

FlyerView ofrece funciones equivalentes esenciales en iOS y Android. Algunas características pueden variar temporalmente por versión, dispositivo, región, revisión de las tiendas, configuración o despliegue técnico.

Usuario: puede ver flyers, seguir negocios, reaccionar, buscar y reportar contenido. No puede publicar flyers como negocio.
Negocio: puede administrar un perfil comercial público, recibir seguidores y administrar hasta dos portadas. Las portadas no requieren una suscripción Pro.
Negocio Pro: conserva todas las funciones de negocio y además puede publicar flyers, añadir enlaces externos cuando la función esté disponible y fijar hasta tres flyers en el perfil.

Podemos ajustar, añadir, retirar o reorganizar funciones, siempre respetando las obligaciones aplicables a suscripciones ya adquiridas y los derechos obligatorios del consumidor.

4. Perfiles y visibilidad

Los perfiles de negocios y el contenido que estos decidan publicar son públicos dentro de FlyerView y pueden aparecer en búsquedas, resultados geográficos, listas y otras áreas de la App.

Los perfiles de usuarios normales no aparecen en la búsqueda pública general. Pueden ser accesibles en contextos limitados derivados de interacciones dentro de FlyerView, incluidos seguidores de un negocio, personas que hayan visto contenido del negocio y otras superficies equivalentes que podamos habilitar. Estos perfiles limitados pueden mostrar la información necesaria para identificar la cuenta y ofrecer acciones disponibles como bloquear o reportar.

La disponibilidad de un perfil en esos contextos no autoriza a utilizar su información para acoso, vigilancia, contacto abusivo, recopilación masiva de datos o fines externos no autorizados.

5. Contenido del usuario

Usted conserva los derechos que posea sobre el contenido que publica o proporciona, incluidos flyers, imágenes, portadas, textos, información comercial, menciones y enlaces. Usted es responsable de ese contenido y de las consecuencias de publicarlo.

Al proporcionar contenido a FlyerView, declara que:

es propietario o cuenta con permisos y licencias suficientes;
el contenido y su uso no infringen derechos de propiedad intelectual, privacidad, imagen, publicidad, contrato ni otros derechos;
la información comercial, precios, condiciones y promociones son exactos y no engañosos; y
el contenido cumple las leyes aplicables y estos Términos.

6. Licencia sobre el contenido

Al enviar contenido, otorga a ROLY STUDIO LLC una licencia mundial, no exclusiva, libre de regalías, sublicenciable a nuestros proveedores técnicos y limitada a operar, alojar, almacenar, reproducir, mostrar, adaptar técnicamente, distribuir dentro de FlyerView, moderar, indexar, extraer texto y hacer disponible dicho contenido conforme a las funciones de la App.

Esta licencia no transfiere su propiedad ni nos autoriza a vender su contenido como obra independiente. Finaliza cuando el contenido se elimina de nuestros sistemas activos, salvo copias técnicas temporales, contenido legítimamente conservado por reportes o ley, y usos necesarios para proteger derechos o resolver disputas.

7. Contenido y conductas prohibidas

No puede publicar, enlazar ni facilitar contenido o conductas que:

sean ilegales, fraudulentos, engañosos o faciliten delitos;
infrinjan propiedad intelectual, privacidad, imagen u otros derechos;
incluyan explotación sexual, contenido sexual ilegal o cualquier material relacionado con abuso de menores;
promuevan odio, violencia, terrorismo, amenazas, acoso o discriminación ilegal;
incluyan suplantación, estafas, esquemas engañosos o afirmaciones comerciales falsas;
divulguen datos personales sensibles de terceros sin autorización;
contengan malware, phishing, enlaces maliciosos o intentos de eludir medidas de seguridad;
constituyan spam, automatización abusiva, scraping, manipulación de resultados o interferencia con la App; o
infrinjan restricciones de edad, licencias, publicidad o leyes aplicables a productos regulados.

Está prohibido intentar acceder a cuentas, sistemas, claves, datos o funciones sin autorización; realizar ingeniería inversa salvo cuando la ley lo permita; saturar la infraestructura; eludir bloqueos; crear cuentas para evadir sanciones; o utilizar FlyerView para desarrollar bases de datos no autorizadas.

8. Responsabilidades de los negocios

Cada negocio es el único responsable de sus productos, servicios, promociones, precios, disponibilidad, licencias, permisos, impuestos, garantías, cumplimiento e información publicada. FlyerView no es parte de una transacción entre un negocio y un usuario, no procesa la compra de los productos anunciados y no garantiza la calidad, existencia, legalidad o entrega de una oferta.

Los negocios deben identificar con claridad restricciones, fechas, condiciones, cantidades, ubicaciones, edad mínima y demás información material. No pueden presentar una promoción vencida, inexistente o sustancialmente distinta de lo anunciado.

Cuando un negocio mencione a otro negocio en un flyer, la mención debe ser pertinente, exacta y no engañosa. Una mención no implica respaldo, asociación comercial ni aprobación por parte del negocio mencionado o de FlyerView.

9. Alcohol y otros productos regulados

FlyerView no vende ni suministra bebidas alcohólicas. Los negocios que publiquen contenido relacionado con alcohol son responsables de cumplir las leyes locales sobre licencias, edad, publicidad, venta, servicio y consumo. Está prohibido dirigir ofertas de alcohol a menores o fomentar consumo peligroso.

La misma responsabilidad se aplica a cualquier otro producto o servicio regulado. FlyerView puede restringir o retirar contenido cuando exista riesgo legal, de seguridad o incumplimiento de políticas.

10. Flyers, feed y flyers fijados

Un flyer ordinario puede aparecer en el feed general durante aproximadamente 24 horas. Un negocio Pro puede fijar hasta tres flyers en su perfil por 3, 7 o 30 días, según la opción seleccionada. El flyer fijado es el mismo contenido publicado originalmente.

Fijar un flyer no prolonga su presencia en el feed general. Después de las primeras 24 horas, permanece visible únicamente en el perfil mientras dure el periodo fijado. Puede retirarse antes por decisión del negocio, vencimiento o pérdida de la suscripción, reporte, moderación, eliminación de cuenta, razones técnicas o exigencias legales.

Publicar, fijar o posicionar un flyer no garantiza visualizaciones, seguidores, contactos, ventas, posición en resultados ni rendimiento comercial. Los tiempos de visibilidad son aproximados y pueden verse afectados por procesamiento técnico.

11. Búsqueda, ubicación y resultados

FlyerView utiliza Typesense Cloud para búsqueda e indexación y puede utilizar ubicación autorizada, ciudad, país, distancia, idioma, relevancia y otros factores para ordenar resultados. La información principal se obtiene de nuestros sistemas y del contenido proporcionado por usuarios y negocios.

Los resultados pueden ser incompletos, estar desactualizados o contener errores. No garantizamos que un negocio o flyer aparezca, conserve una posición determinada o se muestre a una audiencia específica. Está prohibido manipular artificialmente la búsqueda, ubicación, reacciones, seguidores o visibilidad.

12. Enlaces externos

Los negocios elegibles pueden añadir enlaces externos. FlyerView puede utilizar verificaciones técnicas automatizadas, como Google Web Risk, pero estas comprobaciones no garantizan seguridad, exactitud o legalidad. No controlamos los sitios externos ni somos responsables de su contenido, disponibilidad, productos, políticas o prácticas.

El acceso a sitios externos es voluntario y bajo su propio riesgo. Debe revisar sus términos y políticas antes de proporcionar información o realizar una transacción.

13. Moderación, reportes y medidas

Podemos utilizar sistemas automáticos, OCR, verificación de enlaces, revisión humana y proveedores externos para detectar, revisar y gestionar contenido o conducta potencialmente prohibida. Los usuarios pueden reportar, según las funciones disponibles, flyers, cuentas, portadas, enlaces u otro contenido.

Podemos, con o sin aviso previo cuando resulte razonable y legal:

rechazar, limitar, desindexar, ocultar o eliminar contenido;
desactivar enlaces o funciones;
advertir, limitar, suspender o cerrar cuentas;
cancelar beneficios obtenidos mediante fraude o error; y
preservar información o colaborar con autoridades cuando la ley lo requiera.

Los sistemas pueden equivocarse. Puede solicitar revisión escribiendo a info@rolystudio.net. No estamos obligados a mantener contenido que infrinja estos Términos ni a revelar información que comprometa seguridad, privacidad, investigaciones o derechos de terceros.

14. Suscripciones Pro

FlyerView puede ofrecer suscripciones Pro mensuales y anuales mediante Apple App Store y Google Play. Los precios, impuestos, moneda, disponibilidad, periodo y beneficios vigentes se muestran antes de confirmar la compra y pueden variar por plataforma o región.

Cuando se ofrezca una prueba gratuita, precio introductorio u otra promoción, su duración, precio posterior y requisitos de elegibilidad se mostrarán antes de confirmar la compra. Salvo que cancele dentro del plazo indicado, la suscripción se renovará automáticamente y la tienda correspondiente cobrará el precio mostrado para el siguiente periodo. Las ofertas pueden estar limitadas a usuarios elegibles y sujetas a las reglas de la tienda.

Las suscripciones se renuevan automáticamente hasta su cancelación. Debe administrarlas o cancelarlas mediante la cuenta de Apple o Google utilizada para comprar. Eliminar FlyerView o eliminar una cuenta no cancela automáticamente una suscripción administrada por la tienda. Tras cancelar, normalmente conservará acceso hasta finalizar el periodo ya pagado, salvo reembolso, fraude, contracargo u otra regla aplicable.

Los reembolsos y disputas de facturación se tramitan de acuerdo con las políticas de Apple App Store o Google Play y la legislación obligatoria aplicable. FlyerView no garantiza que una solicitud de reembolso sea aprobada. Podemos verificar recibos y estado de compra para activar, restaurar o retirar beneficios Pro.

Podemos modificar precios o beneficios para periodos futuros, proporcionando los avisos y opciones exigidos por la tienda y la ley. Una pérdida temporal de una función no crea por sí sola derecho a reembolso, sin perjuicio de derechos obligatorios por falta de conformidad de un servicio digital.

15. Privacidad y permisos

Nuestra Política de Privacidad explica cómo recopilamos, utilizamos, compartimos y conservamos información. Al utilizar funciones que requieren ubicación, notificaciones u otros permisos, puede aceptar o rechazar la solicitud del sistema. La denegación puede limitar determinadas funciones.

16. Eliminación y cierre de cuenta

Puede solicitar eliminación desde la función disponible en FlyerView o por correo. Eliminar la App del dispositivo no elimina la cuenta ni cancela una suscripción.

La eliminación inicia un proceso para borrar o anonimizar información asociada en nuestros sistemas y proveedores, incluidos Firebase y Typesense, sujeto a periodos técnicos, reportes, transacciones, seguridad, prevención de fraude, disputas y obligaciones legales descritas en la Política de Privacidad.

17. Propiedad de FlyerView

FlyerView, su software, diseño, marcas, logotipos, interfaces, selección y organización de contenido, salvo contenido de usuarios o terceros, pertenecen a ROLY STUDIO LLC o a sus licenciantes y están protegidos por leyes de propiedad intelectual.

Le concedemos una licencia personal, limitada, revocable, no exclusiva, no transferible y no sublicenciable para utilizar la App conforme a estos Términos. Ninguna disposición le concede derechos sobre nuestras marcas o tecnología. Las sugerencias voluntarias podrán utilizarse para mejorar FlyerView sin obligación de compensación, siempre que no incluyan información confidencial de terceros.

18. Proveedores y disponibilidad

FlyerView depende de proveedores externos, incluidos Google Firebase y Google Cloud, Typesense Cloud, Apple y Google. Interrupciones, cambios, límites o fallos de esos servicios pueden afectar funciones, búsqueda, autenticación, notificaciones, almacenamiento o compras.

Podemos realizar mantenimiento, actualizar, modificar, suspender o retirar partes de FlyerView. Procuraremos actuar razonablemente respecto de funciones pagadas, pero no garantizamos funcionamiento ininterrumpido, ausencia de errores, compatibilidad con todos los dispositivos o disponibilidad permanente en cada país.

19. Descargos de responsabilidad

En la máxima medida permitida por la ley, FlyerView se proporciona “tal cual” y “según disponibilidad”. ROLY STUDIO LLC no ofrece garantías expresas o implícitas de comerciabilidad, idoneidad para un propósito particular, titularidad, no infracción, disponibilidad, exactitud o resultados comerciales.

No respaldamos ni verificamos de manera exhaustiva a usuarios, negocios, flyers, ofertas, menciones o enlaces. Usted debe ejercer criterio antes de visitar un lugar, confiar en una promoción, abrir un enlace o realizar una compra externa. Nada en estos Términos excluye garantías o remedios que legalmente no puedan excluirse.

20. Limitación de responsabilidad

En la máxima medida permitida por la ley, ROLY STUDIO LLC y sus miembros, administradores, empleados, contratistas y proveedores no serán responsables por daños indirectos, incidentales, especiales, consecuentes, ejemplares, pérdida de beneficios, ingresos, oportunidades, datos, reputación o interrupción comercial derivados del uso o imposibilidad de uso de FlyerView.

En la máxima medida permitida por la ley, nuestra responsabilidad total por reclamaciones relacionadas con FlyerView no excederá el mayor de: (a) el importe pagado directamente por usted por FlyerView durante los 12 meses anteriores al hecho que originó la reclamación; o (b) 100 dólares estadounidenses.

Estas limitaciones no se aplican cuando estén prohibidas, incluidos los supuestos de dolo, culpa grave, lesiones personales u otras responsabilidades que no puedan limitarse conforme a la ley aplicable. Algunos países o estados no permiten determinadas exclusiones, por lo que pueden no aplicarse completamente.

21. Indemnización

En la medida permitida por la ley, usted acepta defender, indemnizar y mantener indemne a ROLY STUDIO LLC frente a reclamaciones de terceros derivadas de su contenido, negocio, productos, promociones, incumplimiento de estos Términos, infracción de derechos o uso ilegal de FlyerView. Esta obligación no se aplica en la medida en que la reclamación resulte de nuestra propia conducta ilícita y no limita derechos obligatorios de consumidores.

22. Ley aplicable y disputas

Antes de iniciar una reclamación formal, usted y ROLY STUDIO LLC procurarán resolverla de buena fe mediante comunicación a info@rolystudio.net.

Salvo que la legislación obligatoria disponga otra cosa, estos Términos se rigen por las leyes del Estado de Texas, sin aplicar sus reglas sobre conflicto de leyes, y las disputas se presentarán ante tribunales competentes ubicados en el Condado de Harris, Texas.

Si usted es consumidor del Espacio Económico Europeo, Reino Unido u otra jurisdicción con protecciones obligatorias, conserva los derechos y foros que no puedan excluirse por contrato. Estos Términos no reducen derechos obligatorios relativos a servicios digitales, reembolsos, cancelación, conformidad o reparación.

23. Términos de las tiendas

Su descarga y uso también están sujetos a las reglas de la tienda correspondiente. En iOS, se aplica el EULA estándar de Apple cuando corresponda. Apple no es responsable de operar, mantener o prestar soporte de FlyerView, salvo obligaciones que la ley o sus propios términos le impongan.

En Android, también se aplican los Términos de Servicio de Google Play. Las reglas de la tienda controlan la facturación, cancelación y determinados reembolsos procesados por ella.

24. Suspensión y terminación

Puede dejar de utilizar FlyerView en cualquier momento. Podemos limitar, suspender o terminar acceso cuando exista incumplimiento, riesgo, fraude, abuso, obligación legal, falta de pago, uso perjudicial o necesidad de proteger la App o a terceros.

Cuando resulte razonable, podremos proporcionar aviso u oportunidad de revisión. Las disposiciones que por su naturaleza deban continuar —incluidas propiedad intelectual, licencias ya necesarias, responsabilidad, indemnización, disputas y conservación legal— sobrevivirán a la terminación.

25. Cambios en estos Términos

Podemos actualizar estos Términos para reflejar cambios en FlyerView, proveedores, modelos comerciales o legislación. Publicaremos la versión actualizada y cambiaremos la fecha superior. Si un cambio es material, proporcionaremos aviso adicional cuando corresponda.

Los cambios se aplicarán desde la fecha indicada, salvo que la ley exija otro periodo. Continuar utilizando FlyerView después de la entrada en vigor constituye aceptación; si no está de acuerdo, debe dejar de utilizar la App y cancelar cualquier suscripción futura mediante la tienda.

26. Disposiciones generales

Estos Términos y la Política de Privacidad constituyen el acuerdo aplicable sobre FlyerView, sin perjuicio de condiciones mostradas al realizar una compra. Si una disposición resulta inválida, se aplicará en la máxima medida permitida y el resto continuará vigente. No ejercer un derecho no implica renuncia.

Usted no puede ceder estos Términos sin nuestro consentimiento. Nosotros podemos cederlos como parte de una reorganización, financiación, fusión, adquisición o transferencia de FlyerView, sujeto a la ley. No somos responsables por retrasos causados por acontecimientos razonablemente fuera de nuestro control.

These Terms form an agreement between you and ROLY STUDIO LLC regarding your use of FlyerView on iOS and Android. By creating an account, accessing, or using FlyerView, you agree to these Terms and our Privacy Policy.

1. Who we are and acceptance

FlyerView is an application developed and operated by ROLY STUDIO LLC (“FlyerView,” “we,” “us,” or “our”), a company established in the United States. These Terms and Conditions (“Terms”) govern your access to and use of the FlyerView application (“App”), its features, content, and related services.

If you do not accept these Terms, do not use FlyerView. If you use the App on behalf of a company or organization, you represent that you have authority to bind it to these Terms.

2. Eligibility and accounts

You must be at least 18 years old and legally capable of accepting these Terms. The App is not intended for minors.

You must provide accurate information, keep it current, protect your credentials, and notify us if you suspect unauthorized access. You are responsible for activity under your account, except where the law provides otherwise. You may not sell, transfer, rent, or share an account in a manner that compromises its security or FlyerView's operation.

We may request reasonable verification to protect accounts, validate subscriptions, investigate fraud, or confirm that a person is authorized to manage a business.

3. Platforms and account types

FlyerView provides substantially equivalent core functionality on iOS and Android. Certain features may temporarily vary by version, device, region, store review, configuration, or technical rollout.

User: may view flyers, follow businesses, react, search, and report content. A User cannot publish flyers as a business.
Business: may manage a public business profile, receive followers, and manage up to two covers. Covers do not require a Pro subscription.
Pro Business: retains all Business functionality and may also publish flyers, add external links where available, and pin up to three flyers to its profile.

We may adjust, add, remove, or reorganize features while honoring obligations applicable to existing subscriptions and mandatory consumer rights.

4. Profiles and visibility

Business profiles and the content businesses choose to publish are public within FlyerView and may appear in search, geographic results, lists, and other areas of the App.

Regular User profiles do not appear in general public search. They may be accessible in limited contexts arising from interactions within FlyerView, including a business's followers, people who viewed the business's content, and other equivalent surfaces we may enable. These limited profiles may display information needed to identify the account and offer available actions such as blocking or reporting.

Availability of a profile in these contexts does not authorize use of its information for harassment, surveillance, abusive contact, bulk data collection, or unauthorized external purposes.

5. User content

You retain any rights you hold in content you publish or provide, including flyers, images, covers, text, business information, mentions, and links. You are responsible for that content and the consequences of publishing it.

By providing content to FlyerView, you represent that:

you own it or have sufficient permissions and licenses;
the content and its use do not infringe intellectual property, privacy, publicity, contract, or other rights;
business information, prices, conditions, and promotions are accurate and not misleading; and
the content complies with applicable law and these Terms.

6. Content license

By submitting content, you grant ROLY STUDIO LLC a worldwide, non-exclusive, royalty-free license, sublicensable to our technical providers, and limited to operating, hosting, storing, reproducing, displaying, technically adapting, distributing within FlyerView, moderating, indexing, extracting text from, and making that content available according to App functionality.

This license does not transfer your ownership or allow us to sell your content as a standalone work. It ends when content is deleted from our active systems, except for temporary technical copies, content lawfully retained for reports or legal reasons, and uses needed to protect rights or resolve disputes.

7. Prohibited content and conduct

You may not publish, link to, or facilitate content or conduct that:

is illegal, fraudulent, misleading, or facilitates crime;
infringes intellectual property, privacy, publicity, or other rights;
includes sexual exploitation, illegal sexual content, or any child abuse material;
promotes hatred, violence, terrorism, threats, harassment, or unlawful discrimination;
includes impersonation, scams, deceptive schemes, or false commercial claims;
discloses another person's sensitive personal information without authorization;
contains malware, phishing, malicious links, or attempts to bypass security measures;
constitutes spam, abusive automation, scraping, result manipulation, or interference with the App; or
violates age restrictions, licenses, advertising requirements, or laws governing regulated products.

You may not attempt to access accounts, systems, keys, data, or features without authorization; reverse engineer except where the law permits; overload infrastructure; evade blocks; create accounts to circumvent enforcement; or use FlyerView to develop unauthorized databases.

8. Business responsibilities

Each business is solely responsible for its products, services, promotions, prices, availability, licenses, permits, taxes, warranties, compliance, and published information. FlyerView is not a party to a transaction between a business and a user, does not process purchases of advertised products, and does not guarantee the quality, existence, legality, or delivery of an offer.

Businesses must clearly identify restrictions, dates, conditions, quantities, locations, minimum ages, and other material information. They must not present an expired, nonexistent, or materially different promotion as available.

When a business mentions another business in a flyer, the mention must be relevant, accurate, and not misleading. A mention does not imply endorsement, a commercial relationship, or approval by the mentioned business or FlyerView.

9. Alcohol and other regulated products

FlyerView does not sell or supply alcoholic beverages. Businesses that publish alcohol-related content are responsible for complying with local laws governing licenses, age, advertising, sale, service, and consumption. Alcohol offers must not target minors or encourage dangerous consumption.

The same responsibility applies to any other regulated product or service. FlyerView may restrict or remove content where a legal, safety, or policy risk exists.

10. Flyers, feed, and pinned flyers

An ordinary flyer may appear in the general feed for approximately 24 hours. A Pro Business may pin up to three flyers to its profile for 3, 7, or 30 days, depending on the selected option. A pinned flyer is the same content that was originally published.

Pinning does not extend a flyer's presence in the general feed. After the first 24 hours, it remains visible only on the profile during the pinned period. It may be removed earlier by the business, expiration or loss of subscription, report, moderation, account deletion, technical reasons, or legal requirements.

Publishing, pinning, or positioning a flyer does not guarantee views, followers, contacts, sales, search rank, or business performance. Visibility periods are approximate and may be affected by technical processing.

11. Search, location, and results

FlyerView uses Typesense Cloud for search and indexing and may use authorized location, city, country, distance, language, relevance, and other factors to order results. Primary information comes from our systems and content provided by users and businesses.

Results may be incomplete, outdated, or inaccurate. We do not guarantee that a business or flyer will appear, retain a particular position, or be shown to a specific audience. Artificial manipulation of search, location, reactions, followers, or visibility is prohibited.

12. External links

Eligible businesses may add external links. FlyerView may use automated technical checks such as Google Web Risk, but those checks do not guarantee safety, accuracy, or legality. We do not control external websites and are not responsible for their content, availability, products, policies, or practices.

Access to external websites is voluntary and at your own risk. You should review their terms and policies before providing information or completing a transaction.

13. Moderation, reports, and enforcement

We may use automated systems, OCR, link verification, human review, and external providers to detect, review, and manage potentially prohibited content or conduct. Depending on available features, users may report flyers, accounts, covers, links, or other content.

We may, with or without advance notice where reasonable and lawful:

reject, limit, de-index, hide, or remove content;
disable links or features;
warn, limit, suspend, or close accounts;
revoke benefits obtained through fraud or error; and
preserve information or cooperate with authorities where legally required.

Systems can make mistakes. You may request review by emailing info@rolystudio.net. We are not required to maintain content that violates these Terms or disclose information that would compromise security, privacy, investigations, or third-party rights.

14. Pro subscriptions

FlyerView may offer monthly and annual Pro subscriptions through Apple App Store and Google Play. Current prices, taxes, currency, availability, period, and benefits are displayed before purchase and may vary by platform or region.

When a free trial, introductory price, or other promotion is offered, its duration, subsequent price, and eligibility requirements will be displayed before purchase. Unless you cancel within the stated period, the subscription will automatically renew and the relevant store will charge the displayed price for the next period. Offers may be limited to eligible users and are subject to store rules.

Subscriptions automatically renew until canceled. You must manage or cancel them through the Apple or Google account used to purchase. Deleting FlyerView or deleting an account does not automatically cancel a store-managed subscription. After cancellation, access will normally continue through the paid period, except in cases of refund, fraud, chargeback, or another applicable rule.

Refunds and billing disputes are handled according to Apple App Store or Google Play policies and mandatory applicable law. FlyerView does not guarantee approval of a refund request. We may verify receipts and purchase status to activate, restore, or revoke Pro benefits.

We may change prices or benefits for future periods while providing any notice and options required by the store and the law. Temporary loss of a feature does not by itself create a refund right, without prejudice to mandatory remedies for lack of conformity of a digital service.

15. Privacy and permissions

Our Privacy Policy explains how we collect, use, share, and retain information. When using features that require location, notifications, or other permissions, you may accept or reject the system request. Denial may limit certain features.

16. Account deletion and closure

You may request deletion through the available FlyerView feature or by email. Removing the App from your device does not delete the account or cancel a subscription.

Deletion begins a process to erase or anonymize associated information in our systems and providers, including Firebase and Typesense, subject to technical periods, reports, transactions, security, fraud prevention, disputes, and legal obligations described in the Privacy Policy.

17. FlyerView ownership

FlyerView, its software, design, trademarks, logos, interfaces, and selection and arrangement of content, excluding user or third-party content, belong to ROLY STUDIO LLC or its licensors and are protected by intellectual property laws.

We grant you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the App in accordance with these Terms. Nothing grants rights in our trademarks or technology. Voluntary feedback may be used to improve FlyerView without compensation, provided it does not include third-party confidential information.

18. Providers and availability

FlyerView depends on external providers, including Google Firebase and Google Cloud, Typesense Cloud, Apple, and Google. Their outages, changes, limits, or failures may affect features, search, authentication, notifications, storage, or purchases.

We may maintain, update, modify, suspend, or discontinue portions of FlyerView. We will act reasonably regarding paid features, but do not guarantee uninterrupted operation, error-free service, compatibility with every device, or permanent availability in every country.

19. Disclaimers

To the maximum extent permitted by law, FlyerView is provided “as is” and “as available.” ROLY STUDIO LLC disclaims express or implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and business results.

We do not endorse or comprehensively verify users, businesses, flyers, offers, mentions, or links. You should exercise judgment before visiting a location, relying on a promotion, opening a link, or making an external purchase. Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.

20. Limitation of liability

To the maximum extent permitted by law, ROLY STUDIO LLC and its members, managers, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, or exemplary damages, or loss of profits, revenue, opportunity, data, reputation, or business interruption arising from the use or inability to use FlyerView.

To the maximum extent permitted by law, our total liability for claims relating to FlyerView will not exceed the greater of: (a) the amount you paid directly for FlyerView during the 12 months before the event giving rise to the claim; or (b) US $100.

These limitations do not apply where prohibited, including intentional misconduct, gross negligence, personal injury, or other liability that cannot be limited under applicable law. Some countries or states do not allow certain exclusions, so they may not fully apply.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold ROLY STUDIO LLC harmless from third-party claims arising from your content, business, products, promotions, breach of these Terms, infringement of rights, or unlawful use of FlyerView. This obligation does not apply to the extent a claim results from our own unlawful conduct and does not limit mandatory consumer rights.

22. Governing law and disputes

Before bringing a formal claim, you and ROLY STUDIO LLC will attempt in good faith to resolve it through communication at info@rolystudio.net.

Unless mandatory law provides otherwise, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and disputes will be brought in courts of competent jurisdiction located in Harris County, Texas.

If you are a consumer in the European Economic Area, United Kingdom, or another jurisdiction with mandatory protections, you retain rights and forums that cannot be excluded by contract. These Terms do not reduce mandatory rights concerning digital services, refunds, cancellation, conformity, or remedies.

23. App store terms

Your download and use are also subject to the relevant store rules. On iOS, the Apple Standard EULA applies where relevant. Apple is not responsible for operating, maintaining, or supporting FlyerView, except for obligations imposed by law or Apple's own terms.

On Android, the Google Play Terms of Service also apply. Store rules control billing, cancellation, and certain refunds processed by that store.

24. Suspension and termination

You may stop using FlyerView at any time. We may limit, suspend, or terminate access for breach, risk, fraud, abuse, legal obligation, nonpayment, harmful use, or a need to protect the App or others.

Where reasonable, we may provide notice or an opportunity for review. Provisions that by their nature should continue—including intellectual property, necessary surviving licenses, liability, indemnification, disputes, and lawful retention—will survive termination.

25. Changes to these Terms

We may update these Terms to reflect changes in FlyerView, providers, business models, or law. We will publish the updated version and change the date above. If a change is material, we will provide additional notice where appropriate.

Changes apply from the stated date unless the law requires another period. Continued use after effectiveness constitutes acceptance; if you disagree, you must stop using the App and cancel future subscription renewal through the store.

26. General provisions

These Terms and the Privacy Policy form the agreement applicable to FlyerView, without prejudice to terms displayed when completing a purchase. If a provision is invalid, it will apply to the maximum permissible extent and the remainder will continue. Failure to enforce a right is not a waiver.

You may not assign these Terms without our consent. We may assign them as part of a reorganization, financing, merger, acquisition, or transfer of FlyerView, subject to law. We are not responsible for delays caused by events reasonably beyond our control.
